Regulatory information and scope of services
The information on this website is provided for general corporate and service information only. It does not constitute an offer or solicitation to accept deposits, open or operate bank accounts, provide payment services, hold or transfer client funds, deal in financial instruments, or provide investment advice.
On the basis of the information published here, EMAY Holding GmbH is not represented as a credit institution, payment institution, electronic money institution, investment firm or custodian. Where a project requires regulated financial, payment, banking, securities, insurance, cash-in-transit or other licensed services, those services may only be provided by appropriately authorised and appointed providers. Any such service remains subject to applicable authorisations, due diligence, provider acceptance and separate agreements.
References to potential project finance, EPC+F structures, banking or security solutions do not constitute a financing commitment, bank mandate, guarantee, placement commitment or regulatory approval. Decisions by banks, authorities, central banks and other competent bodies remain solely theirs.
Important publication qualification: Whether any activities actually undertaken – particularly arranging or structuring finance, payment processing, custody, trading or cross-border transfers of money or securities – require authorisation under the German Banking Act (KWG), Payment Services Supervision Act (ZAG), Investment Firm Act (WpIG) or other laws must be assessed against the actual business model. This website wording is not a substitute for that legal assessment.
Privacy Policy
1. Data controller
The controller within the meaning of the General Data Protection Regulation (GDPR) is:
EMAY Holding GmbH, Leyendeckerstraße 6, 50825 Cologne, Germany
Email: info@emay-holding.com
2. Website access and server log data
When this website is accessed, the hosting provider processes technically necessary connection and log data, which may include IP address, date and time of access, requested page/file, data volume, referrer URL, browser and operating-system information and status messages. This processing is required to provide the website securely and reliably, troubleshoot errors and protect against attacks. The legal basis is Article 6(1)(f) GDPR (legitimate interest in a secure and functional website). Log data is retained only for as long as necessary for these purposes and under the applicable hosting contract, and is then deleted or anonymised unless longer retention is required to investigate a security incident.
3. Hosting
This website is provided using web-hosting services from IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. In connection with hosting, IONOS may process personal data as a processor, in particular technical access data and information submitted through the contact form. Processing is governed by a data processing agreement under Article 28 GDPR, where concluded. Details concerning subprocessors, storage locations and deletion periods are determined by the actual IONOS contract and its applicable privacy documentation.
4. Contact form and email enquiries
If you contact us using the contact form or by email, we process the information you provide: name, business email address, organisation (if supplied), subject and message content, together with technical data necessary to transmit the message. We use this information solely to review and respond to your enquiry and, where applicable, to prepare pre-contractual steps or a business relationship.
The legal basis is Article 6(1)(b) GDPR where your enquiry relates to entering into or performing a contract; otherwise Article 6(1)(f) GDPR (legitimate interest in handling business enquiries). Providing information is voluntary except where the form marks a field as required. Without required information, we may be unable to process your enquiry.
Your message is delivered to info@emay-holding.com. Access is limited to personnel handling the enquiry and technical service providers where necessary. We delete enquiries once they have been conclusively handled and no further communication is expected, unless statutory retention duties, legitimate evidentiary interests or a subsequent business relationship justify longer retention. Business and tax-related correspondence may be subject to statutory retention periods.
5. Cookies and third-party services
To the best of our knowledge, the website version prepared for publication does not use analytics, marketing or tracking services, nor externally embedded fonts, maps, videos or social-media plugins. No consent banner for such optional services is therefore included. If non-essential cookies or similar technologies are introduced in the future, they will only be activated after prior consent under Section 25 TDDDG and, where personal data is processed, Article 6(1)(a) GDPR. This policy will then be updated accordingly.
6. Recipients and transfers to third countries
Recipients may include the hosting provider and, where required for email delivery, the provider of the company mailbox, as well as personnel responsible for handling enquiries. The website workflow is not intended to transfer personal data outside the EU/EEA. If such a transfer occurs through a service provider, it will be made only in compliance with Articles 44 et seq. GDPR.
7. Your data protection rights
Subject to the legal requirements, you have the right of access (Article 15 GDPR), rectification (Article 16), erasure (Article 17), restriction of processing (Article 18), data portability (Article 20), and the right to object to processing based on legitimate interests (Article 21 GDPR). You may withdraw consent at any time with effect for the future. You also have the right to lodge a complaint with a supervisory authority (Article 77 GDPR).
The competent data protection supervisory authority for North Rhine-Westphalia is:
State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia
Kavalleriestraße 2–4, 40213 Düsseldorf, Germany
Email: poststelle@ldi.nrw.de
Website: www.ldi.nrw.de
8. Data security
We use appropriate technical and organisational measures to protect personal data against loss, manipulation and unauthorised access. Despite such measures, data transmission over the internet may have security vulnerabilities.
9. No automated decision-making
No automated decision-making, including profiling within the meaning of Article 22 GDPR, is carried out through this website.
10. Updates
This privacy policy will be updated if the website, service providers or data-processing activities materially change.
Consumer dispute resolution
EMAY Holding GmbH is not obliged and is currently not willing to participate in dispute resolution proceedings before a consumer arbitration board. This statement should be reviewed if the statutory information duties under Section 36 VSBG apply to the company in the relevant financial year.
Copyright
The texts, design elements and other content published on this website are subject to applicable copyright law. Any use beyond the statutory exceptions requires the prior consent of the respective rights holder.
Liability for content and links
We prepare the content of this website with reasonable care. However, we cannot guarantee its accuracy, completeness or timeliness. The operators of linked external websites are solely responsible for their content. If we become aware of specific legal infringements, we will review and, where legally required, remove the relevant content or links.
